DEMOCRACY SYSTEM IN INDONESIA
In the same manner as we know Indonesia follows democracy system. But before we discuss about democracy system in Indonesia, we want to explain about the meaning of democracy. Democracy is a form or mechanism system administration of country, as efforts to create sovereignty of citizenry (domination of citizen) to operated by government of the country.
The pillar of democracy is the principle of “tries political” which divide three domination of politic in the country which called executive, judicative, and legislative. To created in three kinds of independent institutes in the country and in the parallel level as one as other. The parallelism and independence of three institutes are needed, so that the third institutes can mutual control and mutual supervise that based on the principle of check and balances.
The third kinds of the institutes are the government institutes which have competence to create and operate the competence of executive. The court of institutes which have the power to operate domination of judicative, and delegation of citizenry (parliament, for Indonesia) which have the power to operate domination of legislative. Under the system, the decision of legislative is made by public or deputy who must work and act accord with aspiration of public that his represented (constituent) and who elect him pass through process general election of legislative besides accord the law and regulation.
The Features of Democracy System
1. The status of chief executive (president) is like a chief executive for government.
2. President and parliament elected direct by citizenry pass the general election, so that will happened president that come from the different party from party of parliament. For example in America, the president election performed pass the institution which called electoral college (committee of voice elector), whereas according to UUD 1945 the change III and IV, president election and deputy of president election operated direct pass the general election without form what is the name like voice collector.
3. President and parliament (Indonesian legislative assembly) can’t influence (overthrow). The cause remember that both of the institutes exactly the same responsible to citizenry. The method like that is form of expansion delegation method of citizenry.
4. President can’t be stopped by parliament in his period position, but if the president do something that break the law, president can be dropped with impeachment (the court of parliament) implementation of impeachment is done by a high judge.
5. In the moment to arrange cabinet, president must request agreement to DPR, so that president just convey the candidate of cabinet, whereas DPR that determine the definitive personnel. Then, president picked up that cabinet after get agreement from parliament.
6. The cabinet that’s picked up by president obedient and responsible to DPR.
The Institutes of Democracy System
Democracy has principle “tries political” which divided into the third politic domination of country. They are executive, judicative and legislative they created in three kinds of independent institute country. And they are at the same level with the others. The following is a few of explaining about the country institutes:
1. Executive
Executive is department of country which responsible to implement or operate the law. It’s the most senior figure according to de facto in executive refer to chief executive. Executive can refer to administration in presidential system or like government in parliament system.
2. Judicative
Judicative institute of judiciary which divided of judge, prosecutor, and magistrate etc. Usually installed by individual chief executive. They operate the duty too in the court of law and work together with dominated of side especially the police in maintain of the law.
3. Legislative
Legislative is deliberative corporation of government with dominated to make the law. Legislative is called with some names. They are; parliament, congress, and national assembly.
In system parliament, legislative is the highest corporation and point to executive. In system presidential, legislative is the same department and independent from executive. As addition legislative usually have domination to raise tax and apply budget and the other money expulsion. Legislative sometimes write agreement and decide to war.
